1. General
Laurel Parnell, PhD’s video recordings contain material that is protected by copyright and other applicable intellectual property laws in the U.S. and other territories and by international treaty provisions. The content of these video recordings may not be modified, copied or reused in any manner without the express permission of Laurel Parnell, PhD, who reserves all rights.
The video recordings are sold to you by Laurel Parnell, PhD, for use only under the terms of use stated herein, and all rights not specifically granted to you are reserved to Laurel Parnell, PhD, and to any third party with ownership rights in the film and documentation used in the video.
2. Permitted Use/Restrictions
2.1 Grant of Limited License. Laurel Parnell, PhD, grants you a non-exclusive, limited, personal and nontransferable license, subject to and conditioned on your compliance with the restrictions set forth herein, to use the video recording provided to you by or on behalf of Laurel Parnell, PhD.
2.2 Limitations of Use for Libraries and Classrooms.
(i). Classroom Use of Videos
Classroom use is permissible only when all of the following conditions are met:
- The performance must be by instructors.
- The performance is in connection with face-to-face teaching activities.
- The entire audience is involved in the teaching activity.
- The entire audience is in the same room or same general area.
- The teaching activities are conducted by a non-profit education institution.
- The performance takes place in a classroom or similar place devoted to instruction.
(ii). Library Use of Videos
- Libraries that permit patrons to watch a DVD or digital video must strictly limit the viewing to one individual or a very small group and must not levy charges or fees.
- Previewing a DVD or digital video before borrowing it is conducted in a private space.
2.3 As a condition of the limited license for the video granted to you herein, you may NOT:
- Publicly exhibit a DVD or digital video in a public room (including an institution’s meeting rooms), whether or not a fee is charged. Such exhibitions require a separate exhibition license from Laurel Parnell, PhD. The only exception would be educational programs meeting all six requirements listed above.
- Publish, display, disclose, rent, lease, modify, loan, distribute, or create derivative works based on a DVD or digital video or any part thereof;
- Copy, decompile, reverse engineer, disassemble, translate, adapt, or otherwise reduce a DVD or digital video to human readable, audible or viewable form;
- Transmit or make a DVD or digital video available over a network where it could be used by multiple computers;
- Make any third-party presentation contained in a DVD or digital video a standalone product; and
- Take any action that will infringe on the intellectual property or other proprietary rights of Laurel Parnell, PhD.
